MWC Media Policies and Guidelines

Welcome to the media credentialing site for the 2010 Conoco Mountain West Conference Men's and Women's Basketball Championships. The tournaments will be held March 9-13 at the Thomas and Mack Center in Las Vegas. Please make sure to read all information on this site before requesting credentials. We look forward to working with you as you make preparations to cover the MWC Basketball Championships.

Credential requests should be submitted by the organization's assigning editor. We ask that you complete ONE APPLICATION PER MEDIA AGENCY, so please coordinate your coverage and include all requests when filling out your application. The sports editor/director or photo editor should submit the request as the "contact" with all employees they assign to cover the event as "attendees".

A "media agency" for purposes of these criteria shall mean a daily or weekly publication, cable system, radio station, television station or television network, or online entity requiring immediate news coverage. "Immediate news coverage" for purposes of these criteria shall mean that the editorial, audio and/or visual deadline for the tournament action being documented occurs not later than 48 hours after the competition at the site has been completed.

Membership in a ‘writers or broadcasters' association (e.g., United States Basketball Writers Association) does not automatically qualify an agency for credentials.

GENERAL

Each individual or entity signing for or using a credential for access to the Mountain West Conference Basketball Championships, and his/her/its employers (each signer, user and employer, a "Bearer"), agrees to the following conditions:

This working credential is issued as a courtesy to an accredited agency (the "Agency") for the sole purpose of providing venue access to an individual representative of the Agency (the "Representative") who has a legitimate working function in connection with the event for which this credential is issued (the "Event"). This Credential is non-transferable and may be revoked at any time without cause. Any unauthorized use of this Credential or violation of its terms subjects the Representative to ejection from the Event stadium or venue(s), revocation of the Credential and prosecution for criminal and civil trespass and other legal action, and subjects the Agency to revocation of its access to future Events, as the Mountain West Conference or member institution or its affiliates, agents or employees (collectively, the "[Mountain West Conference or member institution]") determines at its sole discretion.

Bearer assumes all risks incidental to the performance by the Bearer of Bearer's services in connection with the MWC Championships and assumes all risks incidental to the Events, whether occurring before, during or after the actual playing of the Events, and agrees that the Mountain West Conference, its member institutions, and their respective employees, directors, officers, student-athletes, coaches, and contractors shall not be liable for injuries or loss of personal property or equipment in connection therewith.

This Credential (if issued for a media function) authorizes the use by the Agency, solely for news and editorial coverage of the Event, of any descriptions, accounts, photographs, films, audio or video recordings, or drawings of the Event or of any player interviews, press conferences or other stadium activities related to the Event taken, made, created or compiled by the Agency or the Representative while attending the Event (collectively, "Agency Materials"). For the avoidance of doubt, Agency Materials may not be exploited by the Agency at any time for any purpose other than news and editorial use. Any other use or attempted use by the Representative or the Agency, including any distribution of Agency Materials, including any distribution of Agency Materials to third parties for their use (whether before or after the conclusion of the Event, and whether or not for editorial purposes) and any authorization of any third party to redistribute Agency Materials is expressly prohibited, unless the Agency has obtained the advance written permission of the Mountain West Conference or member institution for such other use. As between the Agency, the Representative and the Mountain West Conference or member institution, the Mountain West Conference or member institution is the exclusive owner of all copyrights, trademarks and other proprietary rights in its names, logos and uniformed designs, and in the Event and all materials (in any and all media) related thereto, except for Agency Materials created pursuant to this credential (to the extent they do not incorporate materials owned by the Mountain West Conference or member institution in accordance with the foregoing).

Bearer shall obtain all necessary licenses, consents or releases permitting the use of any party's proprietary material, including, but not limited to any party's copyrights, trademarks, rights of publicity, rights of privacy or other proprietary of personal rights, however denominated included in any photograph taken or other material obtained in connection with the credential. The Bearer is solely responsible for determining which licenses, consents and releases shall be obtained. Bearer agrees to indemnify the Mountain West Conference and its member institutions and hold them harmless, their officers, agents, contractors, employees from and against any and all liability loss, damage or expense (including reasonable attorneys' fees and expenses) arising out of or relating to: (a) the issuance of the credential, Bearer's presence at the Events, or any other activity of the accredited agency or Bearer in connection with the Events, including without limitation, any claims that the Event Information taken or complied by Bearer infringe the intellectual property rights, publicity rights or other rights of any third party's copyrights, trademarks, rights of publicity, rights of privacy, or other proprietary of personal rights, however denominated; and (b) the presence on the premises of any cameras, wires, cable or other equipment brought thereon by Bearer.

MEDIA

The use of any account, description, picture, photograph, video, audio, reproduction, or other information concerning the Events (the "Event Information") other than for news coverage of, or magazines, books or stories about, the Events, or for First Amendment-protected purposes, is prohibited, except (a) with the prior written consent of the Mountain West Conference or (b) as specifically licensed herein. Nothing in these terms and conditions authorizes or allows Bearer to violate any of the Mountain West Conference or its member institutions trademarks, copyright and other proprietary rights.

Television agencies taping game action shall use the network feed via the video and audio distributing facilities provided by the Mountain West Conference. These agencies recognize that any videos may be used only in connection with a regularly-scheduled television newscast and shall not exceed three (3) minutes in length or a maximum of two (2) minutes in length for a seven-day window in a regularly-scheduled sports content show. The accredited agency may not air highlights of any game until the live telecast of the game by the rightsholding television network has concluded. EXCEPTION: Local affiliates are permitted to show up to 0:45 of highlights from an active game on The Mtn. during their regularly-scheduled news broadcast, with the proviso that they mention the game is currently airing on The Mtn. and display The Mtn. bug during the highlights.

Television stations, networks, cable systems, participating institutions or their designees, are prohibited from making available game film or video to any other organization without advance written permission from the Mountain West Conference, even though the planned use may be editorial in nature. Such film or video may be aired only by the specific station or entity to which this credential is issued. These rights may not be assigned, transferred or otherwise disposed to any person, firm or corporation. Any agency wishing to use Mountain West Conference video in any other manner must obtain written permission for such usage from the Mountain West Conference.

Real-time transmission of streaming video, digital images, real-time audio, including play-by-play and statistics, of any game of the championship is exclusive to the Mountain West Conference Web site and/or any other Web site designated by the MWC and its rightsholders. "Real-time" is defined by the Mountain West Conference as a continuous play-by-play account or live, extended live/real-time statistics, or detailed description of an event.

If media intend to blog/Tweet at a Mountain West Conference championship event, the media entity must indicate so through the credentialing process. Any media entity posting a blog/Tweet during a Mountain West Conference championship must submit a direct link to MWC Multimedia Coordinator Katie Cavender (kcavender@themwc.com). In return, all media entities entering a blog must post the MWC logo and Web site link on their site. All blogs must be free of charge to readers, and must adhere to the conditions and limitations of this Mountain West Conference Blogging Policy.

Each Credential Bearer (including television, Internet, new media, and print publications) has the privilege to blog/Tweet during competition through the Credential Entity. Credential Bearer agrees it will not to post inflammatory or derogatory comments about the MWC, its member institutions, coaches, student-athletes or administration.

The Credential Bearer's blog/Twitter account may also not produce in any form a "real-time" description of the event. Real-time is defined by the Mountain West Conference as a continuous play-by-play account or live, extended live/real-time statistics, or detailed description of an event. Each of the aforementioned descriptions is exclusive to the Mountain West Conference (or MWC member institution) Web site and/or any other Web site designated by the MWC and its rights holders. Periodic updates of scores, statistics or other brief descriptions of the competition throughout the event are acceptable.

Credential Bearer agrees that the determination of whether a blog/Twitter account is posting inflammatory, derogatory or real-time descriptions shall be in the sole discretion of the Mountain West Conference's (or MWC member institution). If the Mountain West Conference (or MWC member institution) deems that a Credential Bearer is producing a real-time description of the contest, the Mountain West Conference (or MWC member institution) reserves all actions against Credential Bearer, including but not limited to, the revocation of the credential.

Under no circumstances may any live video, live audio or game highlights be broadcast or otherwise distributed on the Internet or via any other online service or computer service without the prior written consent of CBS College Sports Network, The Mtn., or Mountain West Conference.

The Mountain West Conference is the owner of trademarks, copyrights, and other proprietary rights connected to the championship. Member institution name, logo, mascot, and other intellectual property of a school, is controlled by each member institution. The member institution name and team name may be used for news purposes and consistent with the First Amendment.

The credential confers on Bearer a limited, non-exclusive and non-transferable license to take photographs of the Events, and to allow the entity that engaged the Bearer to take the photographs to use such photographs, only for news coverage about the Events, other editorial purposes, and reprints of news pages from such entity's publications, provided that such use is not likely to create, or does not actually create confusion in the minds of the trade or public that Bearer or its reprints or any elements therein, or the items on which they are reprinted, are sponsored or endorsed by, or are associated or affiliated with the MWC Basketball Championships or the Mountain West Conference and its member institutions licensed Bearer to use their respective trademarks or copyrights.

In exchange for the access granted by the credential, the Mountain West Conference shall have the right to purchase prints of any published photographs taken by the Bearer in connection with the credential, at the best financial terms offered to third parties, and such the Mountain West Conference shall be licensed at no additional charge to use the photographs for news coverage purposes only. The Mountain West Conference may not distribute reproductions of the photographs to others or license others to reproduce the photographs.

Any secondary use of any picture, audio description, videotape/film or drawing of the game taken or made by the accredited organization or individual to whom this credential has been issued (including, but not limited to, non-editorial, advertising, sales promotion or merchandising) is prohibited without prior specific written approval of the Mountain West Conference. Without limitation, Bearer may not sell any photograph or image that features a student-athlete and/or coach, and may not use the name or likeness of the individual in any commercial or promotion for the media entity.

Radio stations that have not purchased rights shall not carry any broadcast report from courtside on a live basis or any live description of any game action while it is still in progress and are subject to all other requirements as listed in the "MWC radio policies."

Bearer further agrees to release the Mountain West Conference and all persons and educational institutions involved in the management or production of the competition from any claim or liability arising from failure to provide space for telecasting/broadcasting or other facilities for the television/radio station, Internet media, network, cable system, or other media entity.

The Agency and the Representative assume all risks incident to, and hereby release the Mountain West Conference or member institution from, any and all liability arising in connection with, attending the Event and creating and using Agency Materials. The Agency and the Representative agree to indemnify and hold harmless the Mountain West Conference from and against any and all liability, loss, damage or expense resulting from or arising out of the issuance of this Credential, the Representative's presence in the arena or venue, or any other activity of the Agency or Representative in connection with the Event, however caused, whether by negligence or otherwise (including without limitation, any claims that Agency Materials infringe the intellectual property rights, publicity rights or other rights of any third party). Acceptance of this credential constitutes agreement by the Representative and the Agency to abide by the foregoing conditions.
